What Does a ‘State of Emergency’ mean for Tunisia?

Here is what a state of emergency will mean for people living in Tunisia ot the Presidential decree of 26 January 1978.

- The state of emergency may be declared in all or part of the territory of the Republic in cases of imminent danger resulting from serious breaches of public order, or in the case of events of their gravity public calamity character.

- The state of emergency is declared for a maximum period of thirty days fixed by order determines the territorial divisions or within which it takes effect.

- The state of emergency the state of emergency can be extended only following a decree law that allows the extension for a predetermined period of time.

- The state of emergency empowers the Governor in areas specified to do the following:

to prohibit the movement of people or vehicles.

to prohibit any strike or protest decided even before the declaration of the state of emergency;

to stop any person seeking to hinder in any way the action of public authorities;

to proceed to the requisitioning of people and goods essential to the proper functioning of public services and activities of vital interest to the nation.

- The Minister of the Interior may impose the house arrest in a territorial division or a specific locality of any person whose activity is dangerous for safety and order of said zones.

- The Minister of the Interior may order the return of weapons and munitions which require a licence.

- The Minister of the Interior for the entire territory is established the state of emergency, or the governor for the governorship, may order the temporary closure of theaters, pubs and meeting places of all kinds. The Governor may also prohibit meetings which aim to cause or maintain disorder.

- In areas subject to the application of the state of emergency, the authorities referred to in the preceding Article may order searches at home day and night and take all measures to ensure control of the press and publications of all kinds as well as radio broadcasts, film screenings and theater performances.

- Breaches of the provisions of this decree shall be punished by imprisonment of six months to two years and a fine of from 60 to 2500 dinars or one of these penalties.
